We Protect Assets

A Receiver is a temporarily-appointed, disinterested 3rd party “fiduciary” who helps a business or person preserve assets and property while litigation is ongoing. A Receiver is the agent of the court and is appointed by the judge (usually at the request of one of the parties.)  The Receiver’s responsibility is to ensure that property is protected or the business operates without interference or influence from the lawsuit parties. The Receiver reports directly to the judge handling the case and enforces the judge’s orders in the case. 

 

Additionally, Receivers often provide Property Management services, ensuring that properties in or out of litigation are maintained, rented, or managed effectively to preserve their value and generate income, if applicable.

Shōkunin can tackle typical property management and non-performing financial obligations through Rents & Profits Receivership assignments and restore deteriorating property assets through the Health & Safety Code and the California Code of Civil Procedure § 564 receivership.

Assignments can include “packrat” and hoarder properties, disabled owners/occupants unable to comply with abatement orders, police and fire referrals, forced tenant and/or owner relocation, illegal construction or occupation, multi-unit/apartment complex cases, fire damaged properties, slumlord/deceased owner and/or trust owned properties, bank owned/abandoned properties and many more.
